CLAIM: A new United Nations report calls for decriminalizing sexual activity
between adults and minors.
AP’S ASSESSMENT: False. A report published in March by the International
Commission of Jurists in collaboration with the U.N’s AIDS agency called for
enforcing minimum age of consent laws in a non-discriminatory manner. It did
not call for decriminalizing all sexual activity between minors and adults,
spokespersons for the U.N. and the commission confirmed.

◆ Fact Check: UN is not calling for decriminalization of sex with children

The independent report by the International Commission of Jurists (ICJ), which
was launched in March 2023 with U.N. partners, lays out legal principles on
numerous issues, including consensual sexual conduct between people under the
age of 18, as well as consensual sex between mentally disabled adults. The
report emphasizes a human rights-based approach to laws protecting vulnerable
groups from exploitation. It does not advocate for adult sex with children or
with other vulnerable individuals, independent legal experts told Reuters.
Online posts are misrepresenting the report, however.
“The UN is now advocating for the decriminalization of sex with
minors. ‘Sexual conduct involving persons below the domestically prescribed
minimum age of consent to sex may be consensual in fact, if not in law.’
They’re coming for your children, folks,” reads part of an April Instagram
post with over 92,000 likes

The ICJ report

titled, “The 8 March Principles for a Human
Rights-Based Approach to Criminal Law Proscribing Conduct Associated with Sex,
Reproduction, Drug Use, HIV, Homelessness and Poverty,” was launched with the
Joint United Nations Programme on HIV and AIDS (UNAIDS) and the Office of the
United Nations High Commissioner for Human Rights (OHCHR) - although
independently developed and published by the ICJ, according to both ICJ and
the United Nations.
VERDICT
Misleading. The ICJ “8 March Principles” report calls for additional
consideration around criminalizing sexual activity between young people close
in age, independent legal experts and ICJ said. The report does not call for
the overall decriminalization of sex with children, as claimed online.
