1・7午前NHK衛星1で放送された「ABCワールドニュース」は、FBIボストン支局が、殺人任務を委託したギャング2人の任務遂行を邪魔されないようジョセフ・サルヴァチ氏を冤罪で有罪にし、その後も無罪であることを知りながら34年間刑務所につないでいたことと、その経緯を明らかにさせないために、ブッシュ大統領が裁判所に対してでもFBIが情報を提供することを禁じる大統領に署名したことを報じた。
“事件”は1967年に起きたもので、犯罪のでっち上げに携わった当時のFBI係官(氏名メモ忘れ・顔出し)がインタビューに応え、ギャング2人に殺人任務を依頼し、それをスムーズに遂行させるためのもので、でっち上げは司法省の幹部と協議の上で行ったと述べた。
このような事実の発覚を受けて、ブッシュ大統領は、「裁判所が対象であっても、FBIの内部情報を外に出すことを禁じる」大統領令に署名し、それに対し共和党の内部からも批判がでていると報じた。

Man Freed After Serving 34 Years In Mob Killing
A man who admitted to taking part in a notorious mob hit in the '60s walked away a free man Wednesday.
NewsCenter 5's Kelley Tuthill reports that Wilfred Roy French, 72, was released after FBI (news - web sites) documents showed that the agency's star witness lied on the stand. This was part of the same case that led to the release of Joseph Salvati and Peter Limone earlier.
"He didn't get a fair trial, and that's what happened in this case," defense attorney Philip Tracey said. "Some other men, Salvati and Limone, not only didn't get a fair trial, but they weren't even there. They had nothing to do with it. It's a perversion of the judicial system that I've never seen in the 26 years that I've been involved in this system as a prosecutor and a defender."
French spent 34 years in prison after being convicted of being an accessory before the fact in the 1965 mob murder of Teddy Deegan. FBI agents allegedly framed four codefendants, and documents uncovered last year showed that FBI agents knew that their star witness lied.
While prosecutors acknowledged that it was likely that Salvati and Limone had nothing to do with the killing, they said that French was likely involved. They said that French should be released, however, because of the problems in his trial.
"The commonwealth never abandoned the view that Mr. French was a participant and a principal in the murder of Teddy Deegan," assistant district attorney Mark Lee said. "Nonetheless, you have to do what's right, and what's right is to recognize the fact that had these documents been turned over when they should have been turned over, there's no telling what cause or what effect they would have had on the jury's deliberations."
French left the courthouse with his two grown daughters. He did not make any comment to the media, but his attorney said that he needs a hip replacement. Once he gets his health back, he will work on rebuilding his life.

Judge Questioned About FBI Misconduct
A Boston federal judge has been questioned as part of a congressional investigation into FBI (news - web sites) misconduct involving the Boston mob, according to sources.
NewsCenter 5's David Boeri reports that as a federal prosecutor in the '60s, Edward Harrington helped to gain the murder convictions of six men based on the word of his prized informant, Joe Barboza.
The three convicts who are still alive, Joe Salvati, Peter Limone and Wilfred French, are now free because Barboza lied, allegedly with the knowledge of the FBI. Now Congress wants to learn what Judge Harrington knows.
Sources have confirmed for NewsCenter 5 that congressional investigators questioned Judge Harrington at length on Dec. 20 at the federal courthouse in Boston. Based on his answers, the Congressional Committee is now going to call him to Washington.
Harrington built his reputation as a warrior against organized crime. As a federal prosecutor in the '60s and '70s, he turned key mobsters into government witnesses and used them to convict mobsters big and small. As mobsters fell, Harrington rose, eventually to become a U.S. attorney and later a federal judge.
But recently uncovered FBI documents paint one of Harrington's key mob witnesses as an outrageous liar, and they've brought questions for Harrington himself.
"They prosecuted people whom they knew to be innocent and let the real murders get off scott free," defense attorney John Cavicchi said.
One of Harrington's most important witnesses was Joseph Baron Barboza. Upon his testimony, a jury in 1967 convicted Salvati, Limone and four other men of murdering Edward Deagan, while evidence that Barboza may well have been lying was withheld from the defense by the FBI.
"They had an FBI report about a week after the murder which shows that Barboza told a reliable informant that he -- Barboza -- had shot Deagan with a .45," Cavicchi said.
And another informant report that would have been available to federal prosecutor Harrington within a week of the murder, but was withheld from defense attorneys, named a far different set of participants than Barboza did.
"In other words, it would have shown that the complete testimony of Barboza at the trial implicating Greco, Tamaleo and Limone to be a complete and utter falsehood," Cavicchi said.
Even Baron Barboza's own attorney placed him among the ranks of "chronic liars."
"He certainly was one, had been one all his life," F. Lee Bailey said.
Years later, when he ran for attorney general, Harrington still touted his use of Joe Baron Barboza and the convictions Barboza helped him obtain. And when he was nominated for a federal judgeship in 1988 and faced opposition, Harrington wrote this letter to the Senate Judiciary Committee (news - web sites) obtained by NewsCenter 5:
"I never used an accomplice witness unless I was convinced that he was telling the truth and his testimony had been corroborated to the fullest extent possible."
"That is simply not true," Cavicchi said.
Now that the FBI reports withheld from defense attorneys have finally surfaced, Harrington's statement has drawn investigators like a red flag.
One of the defendants who said he was nowhere near the crime scene passed a polygraph test. Yet Harrington never subjected Barboza to a polygraph test.
And when Barboza later told F. Lee Bailey he wanted to admit his lies at trial and Bailey arranged a polygraph, Bailey recently suggested that Harrington stopped it.
"Mr. Harrington ... went to Walpole and somehow the polygraph test went away," Bailey said. "The FBI said, 'Fire Bailey or you are here forever.'"
Harrington was unavailable for comment Friday. In the past, he has not commented on the case.
It is important to note that investigators in Washington have made no public statements accusing Harrington of wrongdoing. The Congressional Committee has the power of subpoena. Sources said Harrington will first be asked to come to Washington for hearings in February.
