　０１年３月に行われた北海道の倶知安町立倶知安中学校の卒業式で、君が代斉唱を妨害したとして道教委から訓告処分を受けた男性教諭（４９）が、道人事委員会に処分の取り消しを求めた請求で、道人事委員会は「懲戒処分の乱用に当たる」として、処分を取り消す裁決を出した。東京地裁は９月、日の丸・君が代を義務付けた東京都教委の通達は憲法が認める思想・信条の自由を侵す」と違憲とした判決が出たばかりだが、文部科学省によると、都道府県の人事委員会で処分を取り消したのは全国初とみられる。

　裁決では、日の丸の掲揚・君が代の斉唱の趣旨や目的は憲法や教育基本法に反するものではないとしながらも、「強制することは教職員の思想、良心への不当な侵害として許されない」として、憲法に違反すると指摘。さらに、校長が君が代斉唱の根拠とする、学習指導要領については、「大綱的な基準とはいい難く、法的拘束力は否定せざるを得ない」としている。

　同中では、卒業式の式次第には国歌斉唱がなく、卒業式の事前練習でも君が代の斉唱を行わなかった。しかし、当日になって、校長が一方的に君が代のカセットテープをレコーダーから流した。このため、教諭はテープを抜き取って斉唱を妨害した。その後、校歌斉唱に移ったが、大きな混乱もなく式は終了した。【千々部一好】

　裁決について、道教委の平山和則・企画総務部長は「懲戒処分が相当とする当方の主張が認められなかったのは誠に遺憾。裁決書の内容を検討して今後の対応を判断したい」とコメントした。

　道人事委の規約によると、一定の理由があれば、人事委に再審請求することはできる。同部訟務グループによると、裁決が不服であっても道教委側から訴訟を提起することはできない。

　請求者の弁護団長である後藤徹弁護士は「（裁決は）憲法が定めた思想・信条の自由から、日の丸・君が代の強制は許されないとしている。子供たちの教育面にも配慮し、評価できる」と話した。

Hokkaido revokes punishment of teacher for obstructing singing of national anthem

SAPPORO -- The Hokkaido Prefectural Government's Personnel Commission has revoked the board of education's punishment of a junior high school teacher for obstructing the singing of the national anthem during the school's graduation ceremony.

"The prefectural board of education's punitive measure constitutes an abuse of its authority," the commission said in handing down the decision. The move is believed to be the first of its kind involving a prefectural government's personnel commission.

The move follows a ruling in September by the Tokyo District Court, which declared that the Tokyo Metropolitan Board of Education's directive forcing schools to hoist the national flag and sing the national anthem during ceremonies is unconstitutional because it violates freedom of thought.

The incident for which the 49-year-old teacher was reprimanded occurred during a graduation ceremony held at the Kucchan Municipal Junior High School in March 2001.

The program did not mention the singing of the national anthem, and teachers and students did not sing it during a preliminary practice.

However, the principal suddenly played a pre-recorded anthem without notifying teachers or students. The teacher immediately removed the tape from the tape recorder, obstructing the singing of the anthem. (Mainichi)
