米軍に「敵の戦闘員」とみなされ、グァンタナモ湾収容所で抑留されているアデル・ハマド氏が釈放されることとなった。この釈放には、ＹｏｕＴｕｂｅのビデオが大きな役割を果たしたのではないか、と見られている。
ハマド氏はスーダン人で、パキスタンやアフガニスタンで病院の事務員や教師として働き、アフガニスタンの難民を助けるチャリティーを手伝っていた。そのチャリティーがアル・カイーダと関連があると見た米軍は、２００２年、ハマド氏を拘束し、グァンタナモ湾に移送した。
軍事委員会の裁判において、ハマド氏は、「自分は無実だ。アル・カイーダとは何の関係もない。」と主張したが、軍事委員会は聞き入れず、同氏を「敵の戦闘員」とみなし、グァンタナモ湾収容所に拘留した。
それ以来、ハマド氏は同収容所に抑留されたままだ。
ハマド氏の弁護を担当した連邦公選弁護士のスティーブ・ワックス氏やウィリアム・ティースデイル氏らは、パキスタン及びアフガニスタンに飛んだ。そしてハマド氏の身辺調査を行った結果、同氏は収容所監禁に値するようなことは何一つ行っていないという結論に達した。ワックス氏らは、ハマド氏を知る人々に証人になってもらい、ビデオ・カメラの前でハマド氏について証言してもらった。そしてそのビデオをＹｏｕＴｕｂｅに載せた。米政府が無実の人間をグァンタナモに抑留している事実を、米国民に知ってもらいたかったのだ。
このビデオは話題になり、ハマド氏の名前も世間に知れ渡るようになった。そんな矢先、国防省からワックス氏に連絡が入り、ハマド氏を釈放すると言ってきたのである。
ワックス氏は、ハマド氏の釈放がＹｏｕＴｕｂｅビデオのお陰であるとは言い切れない、と述べている。しかし、このビデオが世論に影響を及ぼし、そして世論が国防省の決断に影響を及ぼしたことは、まず間違いないと見える。

The Department of Defense recently alerted Oregon's federal public defender's office that three of its clients -- each held as "enemy combatants" at Guantanamo Bay, Cuba -- were eligible for release or transfer.
One of the men, Nazar Gul of Afghanistan, has already been released from the U.S. Naval Base and reached his homeland last week, said Steven T. Wax, Oregon's top public defender in the federal court system.
"He called us after he had gotten home to let us know that he was there with his family," Wax said. "And (there) seemed to have been a warm and emotional reunion."
The Defense Department announced Tuesday that more than 80 such detainees "have been designated for release or transfer, pending discussions with other nations or pending resolution of litigation in U.S. courts." This leaves about 385 detainees at Guantanamo.
While military officials generally don't comment on their annual reviews of detainees, Navy Cmdr. Jeffrey Gordon, a Pentagon spokesman, said in an interview that the latest releases were cut and dried. "We don't want to be the world's jailer," he said.
The Defense Department e-mailed a "Detainee Status Notification" to Wax's office Feb. 22, which cleared for release or transfer three of the seven Guantanamo detainees represented by Oregon's federal public defenders. The releases were subject to diplomatic arrangements with their homelands, he said.
Two other men represented by attorneys in Wax's office -- Adel Hamad of Sudan and Amin Ullah of Afghanistan -- remain on Guantanamo awaiting diplomatic arrangements for their departure. One of those detainees, Hamad, was the subject of a recent mini-documentary on YouTube that presented him as a man wrongly detained since 2003.
"In the court exhibits we submitted and in the YouTube video, we attempted to portray the clients as the innocent humans they are," Wax said.
The attorney pointed out that the government has drawn no formal charges that might have allowed Hamad's lawyers to make a rebuttal.
"All they have said is that he delivered food to refugee camps 15 years ago that had some people associated with them who subsequently may have been affiliated with al-Qaida," Wax said. "Mr. Hamad says, yes, I delivered food to those refugee camps on a couple of occasions; I never saw or met the people the DOD says may have . . . been associated with al-Qaida."
