SOSトーチャー国際事務局は、パレスチナ自治区における下記の状況に関して皆様の緊
急の働きかけをお願いします。
＜事件の概要＞
SOSトーチャー国際事務局は、「ディフェンス・フォー・チルドレン・インターナショ
ナル」のパレスチナ支部と「アル・ハク」より、7人の子どもたち（最も若い子は４歳）
が殴り殺され、13歳の少年が「人間盾」にされたという情報を入手しました。
入手した情報によると、2月の事件（事件No. ISR- FE080304.ESCR、日本語訳No.3422を
参照）に類似した事件で、2004年4月18日から24日の週に、併合壁／アパルトヘイト・ウ
ォールの建設に抗議していた人々を鎮圧するためにガザ地区北部にイスラエル軍が侵攻し
ました。3日間に渡るイスラエル軍による武力侵攻で、7人のパレスチナ人の子どもが殺害
され、さらに40人が負傷しました。武装ヘリコプターを携えたイスラエル軍装甲車と戦車
が北部地区のベイト・ラヒヤとベイト・ハヌンに入ってきました。パレスチナの農地の破
壊を防ごうとブルドーザーに向かって投石したパレスチナ人のデモ参加者に対しイスラエ
ル侵攻軍が重砲と狙撃兵を配備しました。
これらの一連のデモで7人の子どもが死亡しました。ヨゼフ・タレブ・アル・ドアルさ
ん（14歳）、モハメド・アベド・アル・モタレブさん（16歳）、モハメド・ラシーム・ア
ル・マロフォフさん（15歳）、カルダン・ジアド・アブ・ジャラドさん（16歳）、アドア
ン・モハメド・ハムトフさん（15歳）がこの攻撃によって殺害されました。また2人の少
女―4歳のアス、ア・アリ・アブ・クライクさんと9歳のモナ・ハマダ・アブ・タバクさん
はイスラエル軍の侵攻によって殺害されました。アスマさんはイスラエル軍が自宅近くに
催涙弾を投下した後呼吸不全となりました。モナさんもまた近隣でイスラエル軍の発砲に
よって殺害されました。
同消息筋によると、2004年4月22日、モハメド・サイード・エサ・バドワン／バドラン
と呼ばれていた13歳の少年が「人間の盾」として行使されました。併合壁／アパルトヘイ
ト・ウォールの建設に抗議してビドゥで行なわれたデモに平和的に参加していました。正
午ごろ、兵士が投下した爆弾と催涙弾音が鳴り始め、何人かの若者たちが投石しはじめま
した。この時、2人のイスラエル国境警備兵がモハメドさんを逮捕し、殴打し、腕をフロ
ントガラス部分に縛ってジープのボンネットに無理やり座らせ、「人間の盾」にしました。
子どもの解放を試みたモハメドさんの父親とその他の人々は、銃口を向け追い散らした兵
士によってさらに脅されました。さらに「人権のためのラビス」の代表ラビ・アリク・ア
スチャーマンさんが、子どもを釈放のために介入しようとしましたが、代わりに逮捕、殴
打されました。モハメドさんは車に括りつけられ、兵士に何度も殴られたということです。
彼が恐怖と痛みで解放を懇願しているにも関わらず、兵士は止めませんでした。また動く
こともいかなる防護すらできなかったため兵士が発射した催涙ガスの感染に苦しんでいる
ということです。
およそ4時間後に、モハメドさんは紐を解かれジープに強制的に乗せられ、併合壁／ア
パルトヘイト・ウォールのあるアル・サヒまで連れていかれました。そこで軍部より尋問
を受けました。最後に子どもはアル・カライエフの村付近で釈放されました。そこで彼は
親戚が迎えにくるまで一人暗いところで待たなければなりませんでした。モハメドさんは
午後９時ごろにようやく帰宅しました。少年は恐怖から震えが止まらず、片手と背中に痣
があると彼の両親は報告しています。
SOSトーチャー国際事務局は、これらの事件に対して深く憂慮の意を表明します。国際
事務局は、「締約国は、武力紛争において自国に適用される国際人道法の規定で子どもに
関係を有するものを尊重し及びこれらの規定の尊重を確保することを約束する」と定めた
子どもの権利条約の第38条1項に従い、「いかなる子どもも、拷問またはその他の残虐な、
非人道的な若しくは品位を傷つける取り扱い若しくは刑罰を受けないこと。」と定めた子
ども権利条約の第37条(a)をイスラエル当局に対して要求します。
さらに、第2回目に報告されている事件が明らかに「被保護者の所在は、特定の地点ま
たは区域が軍事行動の対象とならないようにするために利用してはならない。」と定めた
「戦時下における民間人の保護に関する1949年のジュネーブ条約（第4条約）」の第28条
に違反しています。「締約国は、特にその権力内にある被保護者に肉体的苦痛を加え、又
はそれらの者をみな殺しにするような性質の措置を執ることを禁止することに同意する。
この禁止は、被保護者の殺害、拷問だけではなく、文民あるいは軍事機関によって行なわ
れることを問わず、その他の残虐な措置にも適用される」と定めた同条約の第32条を侵害
しています。
＜要請行動＞
イスラエル関係当局に対して以下の要請をお願いします。
1. これらの事件、特にモハメド・サイード・エサ・バドワン／バドランを逮捕、非人道
的扱いをした上、殺害に関して徹底的かつ公正に調査し、関与した人物を特定して裁判に
付し、法律に基づき刑事、民事、また／あるいは行政的制裁を行うこと。
2. これらの虐待の犠牲者およびその家族へ適切な補償を保障すること。
3. 国内法および国際人権基準に従い,同国全体において人権及び基本的自由の尊重を保障
すること。

Child Concern/Right to life/Torture, inhuman and degrading treatment/War crime
The International Secretariat of OMCT requests your URGENT intervention in the
following situation in the Palestinian Occupied Territories.
Brief description of the situation
The International Secretariat of OMCT has been informed by Defence for Children
International - Palestine section and Al-Haq of the unlawful killing of seven
children, the youngest of which was 4 years old, and the beating and use of a 13
year old boy as a human shield.
According to the information received, similarly to the February events (see
OMCT/HIC-HLRN Case ISR-FE080304.ESCR), in the week 18-24 April 2004, Israeli
forces entered the northern Gaza Strip so as to repress demonstration against
the building of the Annexation Wall. During the course of the three-day violent
Israeli incursion, seven Palestinian children have been killed and a further 40
injured. Israeli armoured vehicles and tanks, supported by helicopter gunships
raided the northern districts of Beit Lahiya and Beit Hanoun. The Israeli
Occupation Forces deployed heavy artillery and snipers against the Palestinian
demonstrators who threw stones at the bulldozers in an attempt to prevent the
destruction of Palestinian agricultural land.
Seven children died during and shortly after these demonstrations. Yousef Taleb
al-Do'ar (14 years old), Mohammed Abed al-Motaleb al-Ajouri (16 years old),
Mohammed Rassim al-Malfouh (15 years old), Khaldun Ziad Abu Jarad (16 years old),
Radwan Mohammed Hamtou (15 years old) were killed in the attacks. Two girls -
four-year old Asma Ali Abu Qlaiq and nine-year old Mona Hamada Abu Tabaq were
also killed during the Israeli incursions. Asma suffered respiratory failure
after Israeli forces fired tear close canisters near the family's house. Mona
was also in a residential area when she was killed by Israeli gunfire.
According to the same sources, on 22nd April 2004, a 13 year old boy called
Mohammed Said Essa Badwan/Badran was used as a human shield. Mohammed was
peacefully taking part in spontaneous demonstration in Biddo against the
building of the Annexation Wall. Around noon, following the launch of sound
bombs and teargas canisters by the soldiers, some nearby youth started throwing
stones. At this point, two Israeli Border Guards arrested Mohammed, beat him and
forced him to sit on the hood of their jeep, tying his arm to the windshield
screen and then using him as a human shield. Attempts by Mohammed's father and
others to obtain the child's release only resulted in further threats by the
soldiers who dispersed them at gun point. Moreover, Rabbi Arik Ascherman, who
heads the organisation Rabbis for Human Rights, was present and tried to
intervene for the release of the child but was instead arrested and beaten.
Mohammed was reported to have been repeatedly hit by the soldiers while he was
tied to the vehicle. Although he begged them to release him because he was
scared and in pain, they would not. He also reportedly suffered from exposure to
the teargas used by the soldiers, since he could not move nor was he given any
protection.
After about four hours, Mohammed was untied, forced into the jeep and taken
first to Al-Sahl, an area in which the Annexation Wall is being constructed. He
was then questioned by a military officer. Finally the child was released in the
neighbouring village of Al-Kalaileh where he had to wait, alone and in the dark,
for a relative to come and pick him up. Mohammed only returned to his home at
around 9 pm. His parents report that the boy could not stop shivering from fear
and that he had bruises on one hand and on his back.
OMCT expresses its grave concern over these events. OMCT would like to recall
Israel that under article 37 (a) of the Convention on the Rights of the Child,"
no child shall be subjected to torture or other cruel, inhuman or degrading
treatment or punishment [.]"; and that, according to article 38.1 of the same
Convention, "States Parties undertake to respect and to ensure respect for rules
of international humanitarian law applicable to them in armed conflicts which
are relevant to the child". Moreover the second reported incident is a clear
violation of article 28 of the Fourth Geneva Convention Relative to the
Protection of Civilian Persons in Time of War which states that "the presence of
a protected person may not be used to render certain points or areas immune
from military operations" and an infringement of article 32 of the same
convention, according to which "the High Contracting Parties specifically agree
that each of them is prohibited from taking any measure of such a character as
to cause the physical suffering or extermination of protected persons in their
hands. This prohibition applies not only to murder, torture, [.] but also to any
other measures of brutality whether applied by civilian or military agents".
Actions requested
Please write to the authorities in Israel urging them to:
i. order a thorough and impartial investigation into the circumstances of these
events, notably the unlawful killings as well as the arrest and inhuman
treatment of Mohammed Said Essa Badwan/Badran, in order to identify those
responsible, bring them to trial and apply the penal and/or administrative
sanctions as provided by law;
ii. guarantee that adequate reparation is provided to the victims and the
families of the victims of these abuses;
iii. guarantee the respect of human rights and the fundamental freedoms
throughout the country in accordance with national laws and international human
rights standards;

家保護のための監視機構」は、マレーシアにおける下記の状況に関して皆様の働きかけを
お願いします。
＜事件の概要＞
人権擁護家保護のための監視機構は、人権NGO団体のSUARAMより、人権弁護士また人権
活動家でもあるポヌミ・ウタヤクマルさんに対する攻撃と繰り返し嫌がらせが行なわれて
いるという情報を入手しました。
入手した情報によると、2004年5月10日午後７時15分ごろ、ウタヤクマルさんは職場か
ら自宅への帰宅途中のクアランプール市バングサール地区のジャラン・メダング・タンド
ック通りにて、大きなハンマーを振り回す不詳の3人によって攻撃されました。伝えられ
ているところによると、この事件で、襲撃者のうち1人がウタヤクマルさんに銃口を向け
ました。彼は逃げようとしましたが、身体、顔と頭に傷を負いました。
ウタヤクマルさんは過去にも何度か嫌がらせ受けたことがあります。2004年4月27日に
車のフロントガラスが叩き割られ、2004年4月30日に、23歳の拘禁中に死亡された事件に
ついて警察へ嘆願書を提出したため、彼は11人の人々と一緒に逮捕されました。拘禁中に
死亡した事件に関する審理へ出席した後、2003年1月に逮捕され、2日間拘禁されました。
この拘禁中に、彼は虐待、屈辱を受け、下着を脱がされ、9人の警官の前で写真とビデオ
を撮影されました。またウタヤクマルさんは弁護士との接見を拒否されました。当初、彼
は刑法第228条（法廷侮辱罪）および刑法第506条（刑事脅迫罪）に基づいて起訴されまし
たが、彼に対する全ての起訴状は、マレーシア評議会によって組織された抗議後、棄却さ
れました。高等裁判所は確信がなされないまま彼が起訴されたという判決を出しました。
人権擁護家保護のための監視機構は、2004年5月10日の嫌がらせと攻撃が、ウタヤクマ
ルさんの人権活動と関連していることに対して懸念します。彼は警察署内での拘禁中に警
察によって行なわれている虐待および死亡事件の調査に積極的に関わっています。特に先
月、ウタヤクマルさんは警察署拘禁中に死亡したとされているフランシス・ウダヤパンさ
んの事件について積極的に活動を行なっています。この事件は一般市民の関心事となって
います。
人権擁護家保護のための監視機構は、ウタヤクマルさんを嫌がらせおよび命を脅かす行
為に対して深く懸念します。そして1998年12月に国連総会が採択した「人権擁護家保護の
ための宣言」（「普遍的に認められた人権及び基本的自由を社会において伸長、保護する
個人、集団及び組織の権利及び責任のための宣言」）の規定、とくに「すべての者は、個
々にまた他の者と共同して、国内、国際レベルにおいて人権および基本的自由の保護なら
びに実現を伸長、奨励する権利を有する」と定めた第1条、「国家は、この宣言に掲げら
れた権利を正当に行使した結果としてのあらゆる暴力、脅迫、報復、事実上のあるいは法
律上の敵意に満ちた差別、圧力、あるいはその他のあらゆる恣意的な行為に反対し、すべ
ての者を、個々にまたは他の者と共同して、権限ある当局によって確実に保護するための、
すべての必要な措置をとるべきである」と定めた第12条2項に従うようマレーシア当局に
対して要請します。
＜要請行動＞
マレーシア関係当局に対して以下の要請をお願いします。
1. いかなる状況においてもウタヤクマルさん、また他の人権擁護家も心身の安全を確保
すること。
2. ウタヤクマルさんへの襲撃に関して独立かつ公正な調査を行い、関与した人物を特定
して裁判に付し、法律に基づき刑事、民事、また／あるいは行政的制裁を行うこと。
3. マレーシアにおける人権擁護家に対していかなる嫌がらせも止めさせること。

The Observatory for the Protection of Human Rights Defenders, a joint programme
of the World Organisation Against Torture (OMCT) and the International
Federation for Human Rights (FIDH), requests your urgent intervention in the
following situation in Malaysia.
Brief description:
The Observatory has been informed by Suara Rakyat Malaysia (SUARAM) of the
physical attack and repeated acts of harassment against Mr. Ponnusamy
Uthayakumar, a human rights lawyer and activist.
According to the information received, Mr. Uthayakumar was on his way home from
his office, on Jalan Medang Tandok road in the Bangsar area of Kuala Lumpur, at
around 7.15 pm on May 10, 2004, when he was attacked by three unidentified
people wielding a sledge hammer. Reportedly, during the incident one of the
attackers pointed a gun at Mr. Uthayakumar. Although he managed to escape, he
sustained injuries on his body, face and head.
Mr. Uthayakumar had been subjected to acts of harassment in the past. On April
27, 2004, the windshield of his car was smashed. On April 30, 2004, he was
arrested along with eleven persons while they were about to file a police
complaint concerning a case of death in custody of a 23 year old. He was also
arrested in January 2003 and held for two days after attending an inquiry
concerning a case of death in custody. During this detention, he was abused,
humiliated, stripped to the underwear and photographed and video taped in front
of nine police officers. Mr. Uthayakumar was also denied legal representation.
He was initially charged under Section 228 of the Penal Code (contempt of court)
and Penal Code 506 (criminal intimidation) but all charges against him were
dropped after protests organised by the Bar Council of Malaysia. The High Court
found the charges were brought against him in bad faith.
The Observatory fears that these acts of harassment and the attack of May 10,
2004, are related to Mr. Uthayakumar's human rights activities. He has been
actively involved in investigating cases of abuse of police powers and deaths in
police custody. In particular, during the last month, Mr. Uthayakumar has been
actively working on the case of Francis Udayapan, who allegedly died while in
police custody. This case has attracted public interest.
The Observatory is deeply concerned by these acts of harassment and threats to
the life of Mr. Uthayakumar and urges authorities to conform with the provisions
of the Declaration on Human Rights Defenders adopted by the UN General Assembly
on December 9, 1998, in particular article 1, which states that "everyone has
the right, individually and in association with others, to promote and to strive
for the protection and realization of human rights and fundamental freedoms at
the national and international levels" as well as its article 12.2 which
provides that "the State shall take all necessary measures to ensure the
protection by the competent authorities of everyone, individually or in
association with others, against any violence, threats, retaliation, de facto or
de jure adverse discrimination, pressure or any other arbitrary action as a
consequence of his or her legitimate exercise of the rights referred to in the
present Declaration."
Actions requested:
Please write to the Malaysian authorities and ask them to:
i. Ensure in all circumstances the physical and psychological integrity of Mr.
Uthayakumar as well as other human rights defenders;
ii. Order an independent and impartial investigation into the attack on Mr.
Uthayakumar, in order to identify those responsible, bring them before a civil,
competent and impartial tribunal and apply the penal and/or administrative
sanctions provided by law;
iii. Put an end to any kind of harassment against human rights defenders in
Malaysia;
iv. conform to the provisions of the Declaration on Humans Rights Defenders,
adopted by the General Assembly of the United Nations on December 9, 1998, in
particular article 1 and 12.2 above mentioned;
v. ensure in all circumstances respect for human rights and fundamental freedoms
in accordance with international human rights standards.
