SOSトーチャー国際事務局は、イスラエルにおける下記の状況に関して皆様の緊急の働
きかけをお願いします。
＜事件の概要＞
SOSトーチャー国際事務局は、SOSトーチャーのネットワークのメンバー団体である「イ
スラエル拷問防止民衆委員会(PCATI)」より、オサマ・アブ-ヒンさん（28歳）が虐待と拷
問を受け、彼の家族3名が超法規的に処刑されたという情報を入手しました。
入手した情報によると、オサマ・アブ-ヒンさんは2003年5月1日午前11時半頃にガザの
自宅でイスラエル国防軍(IDF)に逮捕されました。この時、IDFの兵士は彼の家に押し入り、
家族3名を殺害しました。イスラエル軍は2003年5月1日午前1時45分頃にガザ市のアル・シ
ャジャイヤ地区に入ってきました。軍隊はアブ・ヒン家の所有する数軒の家を包囲しまし
た。軍はそのうちの1軒で、オサマ・アブ・ヒンさんの兄弟であるユーシフさん（33歳）、
アイマンさん（29歳）、マフムードさん（38歳）が避難していた家に手榴弾を投げました。
軍はこの3名に家から出るようメガホンで呼びかけましたが、彼らは応じませんでした。
その日の午後、この3名が中にいるにも関わらず、軍隊は家に向かって大砲やマシンガン、
戦車砲を複数回撃ちました。屋根が崩壊し、ユーシフさんとマフムードさんはその下敷き
になって死亡しました。アイマンさんの遺体は家の近くで発見されましたが、複数の銃弾
のあとがありました。ユーシフさんはハマスの活動をしていたとして指名手配されていた
ということです。オサマ・アブ・ヒンさんは、親戚のヤッサー・アブ・ヒンさんという25
歳のジャーナリストとともに逮捕されました。兵士らはオサマ・アブ・ヒンさんに手錠を
きつくはめ、目隠しをしてエレズ拘禁施設に移送しました。彼はそこで別の2名（時には3
名）とともに広さ2平米の房に入れられました。この状態は虐待に該当します。
この部屋にはトイレがなく、被拘禁者たちは部屋の隅に置かれたバケツで用を足さなけ
ればならず、このためひどい悪臭がしました。この部屋には照明やマットレスがなく、被
拘禁者たちは床で寝なければなりませんでした。部屋にはガラスのない窓が１つあるだけ
で、被拘禁者は外気やハエ、蚊を防ぐことができませんでした。このエレズ拘禁施設にい
る間にアブ・ヒンさんはイスラエル総合治安局(GSS)職員による数時間にわたる尋問を3回
受けました。尋問者は、起訴されている犯罪を供述しなければ、暴力や性的嫌がらせ、ソ
ドミー（性的逸脱行為）を行うと言って彼を脅迫しました。エレズ拘禁施設にいた最後の
8日間、アブ・ヒンさんは隔離拘禁されました。そして2003年5月18日にアシュケロンにあ
るシクマ拘禁センターに移送されました。
シクマ拘禁センターでは、毎日午前10時から午後8時まで尋問されました。尋問中は、
低い椅子に手足を鎖できつく縛り付けられ、座らされたので、手足が鬱血しました。この
方法は1999年にイスラエル最高裁判所で違法とされている「シャベー」です。SOSトーチ
ャー国際事務局は、1999年にイスラエル最高裁判所が拷問として頻繁に使われている方法
を１つ１つ挙げて違法と決定したことを想起します。裁判所が列挙したのは、暴力的な揺
さぶり、スクワットを長時間させること、「シャベー」（頭に袋をかぶせ、音楽を大音量
で流し、傾いた小さい椅子に縛り付ける）、睡眠妨害（プレッシャーをかける手段として）
、苦痛を与える足枷です。同裁判所は、これらの方法は尋問を受ける人に苦痛を与え（と
くにシャベーのようにいくつかの手法を組み合わせ、格別な苦しみと痛みを与える場合）、
品位を傷つけるために違法であるという判決を出しました。また、1997年に国連拷問禁止
委員会がこれらの手段、とくに組み合わせて使う場合、拷問に該当すると結論づけたとい
う事実を、国際事務局は強調します。
この間、被害者は背中を反らされていました。尋問者は習慣のように彼の顔を平手打ち
し、供述しなければ彼の自宅を破壊し、他の家族を逮捕すると脅迫しました。アブ・ヒン
さんは現在、ネゲブにあるケズィオット拘禁施設で拘禁されています。
SOSトーチャー国際事務局は、アブ・ヒンさんの心身の安全を深刻に憂慮します。国際
事務局は彼の逮捕時に過剰な武力の行使により彼の家族が殺害されたことを非難します。
国際事務局はアブ・ヒンさんの逮捕の状況、虐待と拷問の申し立て、家族の殺害について
徹底かつ公平な捜査を行い、加害者を特定し、裁判に付し、法律に基づいて刑事的もしく
は行政的処分を課すよう、要請します。国際事務局はさらにイスラエル当局に対し、アブ・
ヒンさんと彼の家族に対し適切な損害賠償を保証するよう、要請します。
＜要請行動＞
イスラエル関係当局に対して以下の要請をお願いします。
1. アブ・ヒンさんの心身の安全を保障するのに必要なあらゆる措置を講ずること。
2. 有効な訴状のない勾留ならば彼を即時釈放し、もしそれが存在するならば権限のある
中立な通常裁判所の裁判に付し、如何なる時も彼らの手続的権利を保障すること。
3. アブ・ヒンさんの家族殺害および、彼の逮捕と虐待および拷問に関して徹底的かつ公
正に調査し、関与した人物を特定して裁判に付し、法律に基づき刑事、民事、また／ある
いは行政的制裁を行うこと。
4. アブ・ヒンさんと彼の家族に対して適切な補償を保障すること。
5. 国内法および国際人権基準に従い、同国全体において人権及び基本的自由の尊重を保
障すること。

Arbitrary detention / Extra-judicial killing / Ill treatment / Torture
The International Secretariat of OMCT requests your URGENT intervention in the
following situation in Israel and the Occupied Territories.
Brief description of the situation
The International Secretariat of OMCT has been informed by the Public Committee
Against Torture in Israel, a member of the OMCT network, of the arbitrary arrest
and detention, ill treatment and torture of 28-year old Mr. Osama Abu-Hin, as
well as the extra-judicial killing of three of his family members.
According to the information received, Mr. Osama Abu-Hin was arrested around 11:
30 AM on May 1, 2003 in his home in Gaza when Israeli Defence Forces (IDF)
soldiers broke into his home and killed three members of his family while
arresting him. The Israeli forces moved into the Al Shajaiya neighbourhood in
Gaza City at approximately 1:45 AM on 1.5.03. The forces surrounded a number of
houses belonging to the Abu Hin family. They threw hand grenades at one of the
houses where three of Osama Abu Hin's brothers, Yousuf, 33, Ayman, 29 and
Mahmoud, 38, were taking shelter. Using megaphones, the forces called on the
three to get out of the house but they refused. In the afternoon the forces
fired several artillery, machine gun and tank shells at the house although the
three brothers were still inside. The roof of the house collapsed on Yusuf and
Manmoud killing them. The body of the third brother, Ayman, ws found near the
house. He had been shot several times. Yusuf was reportedly wanted for his
activities in the Hamas. Mr. Osama Abu Hin was arrested along with another
member of the family, Yasser Abu Hin, a 25 year old journalist. The soldiers
tied Mr. Osama Abu-Hin's hands with tight handcuffs, covered his eyes and
transferred him to the Erez detention facility where he was kept in a 2 square
meter cell together with two other persons (and sometimes three) in conditions
that constitute ill treatment.
There was no toilet in the cell and the detainees were forced to use a bucket in
the corner, resulting in extremely bad odours. The cell had no artificial light
or mattresses and the inmates had to sleep on the floor. The cell also had only
one window without glass, thus exposing the inmates to the elements, flies and
mosquitoes. While at the Erez detention facility, Mr. Abu-Hin was interrogated
by the GSS officers three times, lasting four hours each. His interrogators
threatened him with violence, sexual harassment and sodomy if he did not confess
to the crimes he was charged with. During the last eight days of his detention
in the Erez facility, Mr. Abu-Hin was kept in solitary confinement. After that,
on May 18th, 2003, he was transferred to the Shikma detention centre in Ashkelon.
In the Shikma detention centre he was interrogated every single day, from 10:00
AM until 8:00 PM, and during all this time Mr. Abu-Hin was seated on a low stool
with his hands and legs tied in tight-fitting chains, drawing blood. This
technique is part of those known as "Shabeh," which were outlawed by a High
Court of Justice ruling in 1999. OMCT recalls that in 1999 the Israeli High
Court of Justice outlawed, one by one, the most frequently used methods of
torture, beginning with violent shaking, continuing with squatting and the "
shabeh" methods (covering the head with a sack, playing loud music and tying to
a small, tilted chair), and ending up with sleep deprivation (as a means of
applying pressure) and painful shackling. The Court ruled that these methods
cause suffering (and when applied cumulatively - as in the "shabeh" method -
particular suffering and pain) to those being interrogated and degrade their
dignity, and are therefore illegal. In addition, OMCT would like to highlight
the fact that the United Nations Committee Against Torture concluded in 1997
that these methods constitute torture, in particular when used in combination.
During all of this, the victim's back was bent backwards. His interrogators
habitually slapped him on the face and threatened to demolish his home and
arrest the members of his family if he did not confess. Mr. Abu-Hin is currently
being detained at the Ketziot Detention Facility in the Negev.
The International Secretariat of the OMCT is gravely concerned for Mr. Abu-Hin's
physical and psychological integrity. OMCT condemns the excessive use of force
employed during his arrest, which resulted in the killing of three members of
his family members. OMCT calls upon the authorities to order a thorough and
impartial investigation into the circumstances of Mr. Abu-Hin's arrest and the
allegations of the use of ill treatment and torture, as well as the killings of
his family members, in order to identify those responsible, bring them to trial
and apply the penal and/or administrative sanctions as provided by law. OMCT
also urges the authorities in Israel to guarantee that adequate reparation is
provided to Mr. Abu-Hin and his family.
Action requested
Please write to the authorities in Israel urging them to:
i. take all measures necessary to guarantee the physical and psychological
integrity of Mr. Abu-Hin;
ii. order his immediate release in the absence of legal charges that are
consistent with international law and standards, or, if such charges exist,
bring him before an impartial and competent tribunal and guarantee his
procedural rights at all times;
iii. order a thorough and impartial investigation into the circumstances of Mr.
Abu-Hin's arrest and the allegations of the use of ill treatment and torture, as
well as the killings of his family members, in order to identify those
responsible, bring them to trial and apply the penal and/or administrative
sanctions as provided by law;
iv. guarantee that adequate reparation is provided to Mr. Abu-Hin and his family;
v. guarantee the respect of human rights and the fundamental freedoms throughout
the country in accordance with national laws and international human rights
standards.
