SOSトーチャー国際事務局は、イスラエル国における下記の状況に関して皆様の緊急の
働きかけをお願いします。
＜事件の概要＞
人権擁護家保護のための監視機構は、「ディフェンス・フォー・チルドレン・パレスチ
ナ支部(DCI/PS)」より、2003年2月21日にエルサレム在住のDCI/PSの弁護士であるダウド
・ディラウィさんが、エルサレム市内で、娘を病院に連れて行った時にイスラエル兵士に
拘禁されたという情報を入手しました。彼はその後アシュン軍刑務所に連行され、起訴な
く拘禁されており、拷問を受けているといわれています。
入手した情報によると、2月21日、ディラウィさんと妻はエルサレムの旧市街にある病
院に娘を連れて行きました。ディラウィさんは旧市街の薬局に薬を取りに行き、そこでイ
スラエル兵士に止められ、身分証明書の提示を求められました。彼は妻の元に身分証明書
を置いてきていましたが、家族の再会を示す公的書類を提示しました。彼は妻に身分証明
書を持ってくるよう電話で頼みました。彼らは兵士たちによって、屋外で2時間待たされ
ました。その後、ジープが到着し、ディラウィさんは旧市街のバブ・アル・カレール近く
のケシュレ警察署に連行されました。ケシュレ警察は妻に、ディラウィさんは警察署で24
時間勾留されたあと、判事に身柄を預けられると言いました。翌朝8時、妻が警察署に電
話すると、夫はイスラエル情報機関（シャバク）に連行され、尋問のため12日間拘禁され
るだろうと言われました。警察は、妻に夫の居場所を教えず、この期間中の弁護士の面会
も認めませんでした。
2月24日、DCI/PSの別の弁護士がネゲブにあるアシュン軍刑務所でディラウィさんに面
会することができ、そこで彼に対する扱いや移送、拘禁について話を聞くことができまし
た。刑務所への道中、兵士たちは彼を殴打し、ジープの床に押し倒し、ブーツのまま踏み
つけ、こぶしや銃床で彼を殴ったということです。ディラウィさんはひどいあざをつく
り、下顎を骨折していました。ネゲブの検問所では、ストロヴォスキーというロシア系兵
士が、さらに暴力的に彼を殴ったということです。
2月22日午前1時半にアシュン刑務所に着いたディラウィさんは、戸外で腕を上に上げた
姿勢で縛られました。これは「シャバー」として知られる拷問形態です。彼は氷雨と吹雪
の中、午前8時半までこの姿勢をとらされました。彼が刑務官に食事を要求すると、処罰
としてさらに4時間同じ姿勢をとらされました。
入手した情報によると、その後兵士たちがディラウィさんが人権派弁護士であることを
知ると、彼に対する扱いはさらに悪くなりました。ディラウィさんは10ヶ月にわたりDCI/
PSのために、パレスチナ裁判所内の18名弱の政治囚の弁護と調査を行っていました。彼は
パレスチナ地域でDCI/PSの未成年者正義プログラムのコーディネーターをしていました。
これはユニセフが支援している事業です。DCI/PSに参加する前は、ラマラを拠点とするパ
レスチナ人権団体である「アル・ハク」に勤めていました。彼はパレスチナの法的問題に
ついていくつかの書籍や論文を発表しており、その中には、2000年に発表されたパレスチ
ナ国家治安裁判所に関する先駆的な研究論文もあります。
現在ディラウィさんは約80名の被拘禁者とともにアシュン刑務所で起訴も裁判もないま
ま拘禁されており、極度の寒さ、飢え、医療手当てのない中で苦しんでいます。イスラエ
ルの法律ではディラウィさんは起訴も軍事法廷への出頭もないまま12日間拘禁されること
が可能です。この刑務所には公式に管理されておらず、多くの問題は個々の兵士の裁量に
任されています。
人権擁護家保護のための監視機構は、ダウド・ディラウィさんの心身の安全と、彼が拷
問を受けたという申し立てを非常に憂慮しています。さらに監視機構は、イスラエルに蔓
延する人権擁護家、特に人権派弁護士に対する状況の悪化を懸念します。
＜要請行動＞
イスラエル関係当局に対して以下の要請をお願いします。
１．いかなる時もディラウィさんの心身の安全を保障し、緊急問題として彼に適切な医療
を提供すること。一般にイスラエルの人権擁護家に対するいかなる嫌がらせも止めさせる
こと。
２．有効な訴状のない勾留ならばダウド・ディラウィさんを即時釈放すること。
３．これらの事件、特にディラウィさんの基本的権利の侵害や拘禁の際に受けた拷問につ
いてただちに調査し、責任ある者を特定して権限ある中立な通常裁判所の裁判に付し、法
律に基づき刑事、民事、及び／又は行政的制裁を行うこと。
４．ディラウィさんに対して適切な補償を保障すること。
５．1998年12月に国連総会が採択した「人権擁護家保護のための宣言」（「普遍的に認め
られた人権及び基本的自由を社会において伸長、保護する個人、集団及び組織の権利及び
責任のための宣言」）の規定、特に「国家は、この宣言に掲げられた権利を正当に行使し
た結果としてのあらゆる暴力、脅迫、報復、事実上のあるいは法律上の敵意に満ちた差
別、圧力、あるいはその他のあらゆる恣意的な行為に反対し、すべての者を、個々にまた
は他の者と共同して、権限ある当局によって確実に保護するための、すべての必要な措置
をとるべきである」と定めた第12条2項および、「すべての者は、個々にまた他の者と共
同して、国内、国際レベルにおいて人権および基本的自由の保護ならびに実現を伸長、奨
励する権利を有する」と定めた第1条、「人権と基本的自由を弁護する中で、専門的な資
格のある法的支援、あるいはその他の適切な助言または支援を提供、供与すること」と定
めた第9条3項（c）に従うこと。
６．世界人権宣言およびイスラエルを拘束する人権に関する国際諸条約の規定に従うこと。

The Observatory for the Protection of Human Rights Defenders, a joint program of
FIDH and OMCT, requests your URGENT intervention in the following situation in
Israel.
Brief description of the situation :
The Observatory has been informed by Defence for Children International /
Palestine Section (DCI/PS) that, on February 21st 2003, Mr. Daoud Dirawi, lawyer
for DCI/PS and resident of Jerusalem, was detained in Jerusalem by Israeli
soldiers as he was taking his daughter to hospital. He was then taken to the
Asyun military prison where he is currently detained without charges and has
allegedly been subjected to torture.
According to the information received, on 21st of February, Mr. Dirawi and his
wife took their daughter to a hospital in the Old City of Jerusalem. Mr. Dirawi
had gone to get some medicine from a pharmacy in the Old City when he was
stopped by Israeli soldiers who asked him for his ID card. He had left his ID
with his wife but showed them an official paper indicating that he has made
family reunion. He rang his wife to bring his ID. They were made to stand
outside for two hours by the soldiers. Afterwards, a jeep came and took Mr.
Dirawi to Qeshle Police Station near Bab al Khaleel in the Old City. At Qeshle,
the police told Mrs Dirawi that her husband would be kept for 24 hours and then
transferred to a judge. At 8am the following morning, Mrs. Dirawi rang the
police station and they told her that her husband had been taken by the Israeli
Secret Intelligence (Shabak) and he would be kept for interrogation for 12 days.
They refused to tell her where he was or to let him meet with a lawyer during
this period.
On February 24th, another DCI/PS lawyer was able to visit Mr. Dirawi, in Asyun
military prison in the Negev, when he related the details of his treatment,
transportation and detention. Allegedly on the way to the prison, soldiers beat
him, pushed him to the floor of the jeep and stamped on him with their boots,
hitting him with their fists and rifle butts. Mr. Dirawi sustained heavy
bruising and a broken lower jaw. It has been reported that at the Negev
checkpoint, a Russian soldier, Mr. Strovosky, beat him even more violently in a
further attack.
On his arrival at Asyun military prison at 1.30am on February 22nd, Mr. Dirawi
was tied up outside with his hands locked above him, a form of torture known as
"shabah". He was kept in this position throughout the freezing rain and
snowstorm of that night until 8.30am. When he asked the prison guards for food,
he was punished by being kept in this position for a further four hours.
According to the information received, soldiers then found out that Mr. Dirawi
was a human rights lawyer and as a consequence of this his treatment worsened.
Mr. Dirawi has been working for DCI/PS as a researcher and a lawyer for below 18
political prisoners in the Palestinian courts for 10 months. He is the
coordinator of DCI/PS Juvenile Justice Program in the Palestinian Areas, a
program supported by UNICEF. Prior to joining DCI/PS he was employed by Al Haq,
a Palestinian human rights organization based in Ramallah. He is also the author
of several books and research papers on Palestinian legal issues, including a
pioneering study on the Palestinian State Security Court, which was published
in 2000.
At the present time, Mr. Dirawihe is allegedly being held, along with 80 others
in Asyun prison, without charges or trial, suffering from extreme cold, hunger
and lack of medical care. Under Israeli law, Mr. Dirawi can be detained for 12
days without charges or coming before a military judge or court. The prison has
no official administration, and many issues are left up to the individual
soldiers.
The Observatory is gravely concerned for the physical and psychological
integrity of Mr. Daoud Dirawi as well as the allegations of torture used against
him. In addition, the Observatory is seriously concerned by the deteriorating
situation of human rights defenders prevailing in Israel, in particular against
human rights lawyers.
Action requested :
Please write to the authorities of Israel urging them to:
i. Guarantee in all circumstances, the physical and psychological integrity of
Mr. Dirawi and provide him with appropriate medical treatment as a matter of
urgency. In general, put an end to any form of harassment against human rights
defenders in Israel;
ii. Immediately release Mr. Daoud Dirawi in the absence of charges against him;
iii. Order a thorough and impartial investigation into the circumstances of
these events, notably the alleged violations of Mr. Dirawi's fundamental rights
and the physical attacks to which he was subjected in detention, in order to
identify those responsible, bring them to trial and apply the penal, civil and/
or administrative sanctions as provided by law;
iv. Guarantee adequate reparation to Mr. Dirawi;
v. Conform to the provisions of the Declaration on Humans Rights Defenders,
adopted by the General Assembly of the United Nations on December 9, 1998, in
particular article 12.2 which states that "The State should take all necessary
measures to ensure the protection by the competent authorities of everyone,
individually or in association with others, against any violence, threats,
retaliation, de facto or de jure adverse discrimination, pressure or any other
arbitrary action as a consequence of his or her legitimate exercise of the
rights referred to in the present Declaration", article 1 which states that "
everyone has the right, individually or in association with others, to promote
the protection and realization of human rights and fundamental freedoms at the
national and international levels"; and article 9.3.c which states that everyone
has the right "to offer and provide professionally qualified legal assistance
or other relevant advice and assistance in defending human rights and
fundamental freedoms";
vi. Conform to the provisions of the Universal Declaration on Human Rights and
international instruments relating to Human Rights which bind Israel.

＜事件の概要＞
SOSトーチャー国際事務局は、「国際ゲイ・レズビアン人権委員会」より、チリにおい
て10名のトランスヴェスタイト（異性装者）が警察より恣意的に逮捕、虐待、殴打されて
いるという情報を入手しました。
入手した情報によると、2003年2月7日にチリのロス・アンデスにおいて、6名の性産業
労働者であるトランスヴェスタイトが警察に恣意的に逮捕され、殴打されたということで
す。2003年2月8日にも、別の4名のトランスヴェスタイトが同じ目にあっています。ロド
リゴ・ホンクエラ警察署長は、地元の報道機関に対し、彼は市を「きれいにする」つもり
であると宣言し、街頭からトランスヴェスタイトの性産業労働者を排除する意向を表明し
ています。
入手した情報によると、トランスヴェスタイトであるエドアルド・サモラさん、ミゲ
ル・アルヴァレスさん、エルヴィス・マルドナドさん、サルヴァドール・ヴィリャロエル
さん、フアン・Ａ・バリーさん、クラウディオさんが、第3警察署の警察官に恣意的に逮
捕され、殴打、虐待を受けたということです。2003年2月7日、ロス・アンデス第3警察署
の車3台がアヴェニダ・アルゼンチナとサンタ・ロサの交差点に到着し、警告なしにこれ
らの人々を殴打し始め、そして何の犯罪に関する訴状もないまま彼らを逮捕しました。彼
らは警察署に連行され、そこで服を脱がされ、再び殴打されました。後に彼らが提出した
訴えによると、警察官はその後、彼らに水を浴びせ、彼らに体を乾かすことも、体に何か
をかけることも許さず、一晩を房で過ごさせました。彼らは翌朝「節度・良俗違反」で起
訴され、釈放されました。このすべての過程はロドリゴ・ホンクエラ警察署長の承認と監

はサンチャゴとチリの他の都市に支部を持っています。警察の嫌がらせに対する活動をし
ているため、同団体は一度ならず脅迫の標的となっています。2002年7月、同団体のサン
チャゴ支部は、サンチャゴ第4警察の巡査部長と伍長から殺害脅迫を受けたと発表しまし
た。活動家はこの伍長のナンバープレート(947521R)をなんとか記録し、報道機関やカラ
ビネロス（チリ警察の呼び名）秩序・治安局長ネルソン・ゴドイ大将などに訴えました
が、いまだにこの事件に関する調査の進展も解決もありません。2002年6月28日（「プラ
イド・デー」）以来、「トラヴェスチリ」はEメールを通じて嫌がらせメールや殺害脅迫
を大量に受け取っていますが、警察は捜査を拒否しています。「トラヴェスチリ」サンチ
ャゴ支部代表のシルヴィア・パラダさんはサンチャゴ第9刑事裁判所に調査を求める訴え
を提出しましたが、いまだに何の調査も始めれていません。
SOSトーチャー国際事務局は、上述のロス・アンデスのトランスヴェスタイトの人々の
恣意的な逮捕、虐待、殴打および、チリ全国でトランスヴェスタイトの人々が直面してい
る嫌がらせや脅迫を憂慮します。国際事務局はまた、トランスヴェスタイトの人が殺害さ
れた2件の事件を含む、これらの脅迫や襲撃に対する捜査が行われていないことを深刻に
憂慮します。国際事務局は当局に対し、チリにおけるトランスヴェスタイトの人々全員の
心身の安全を保障すること、とくにロス・アンデスの件について、これらの深刻な申し立
てに対する公平かつ効果的な捜査にただちに着手し、加害者を裁判にかけることを要請し
ます。

Arbitrary arrests / Ill-treatment / Violation of personal integrity
The International Secretariat of OMCT requests your URGENT intervention in the
following situation in Chile.
Brief description of the situation
The International Secretariat of OMCT has been informed by the International Gay
and Lesbian Human Rights Commission of the arbitrary arrests, ill-treatment and
beatings to which 10 transvestites have been subjected by the police in Chile.
According to the information received, on February 7th, 2003, six transvestite
sex workers were arbitrarily arrested and beaten by police officers in Los Andes,
Chile. Four different transvestites experienced the same treatment on February
8th, 2003. Police Chief Rodrigo Jonquera has declared to local media that he
will "clean up" the city, signalling his intention to expel transvestite sex
workers from the streets.
According to the information received, Eduardo Zamora, Miguel Alvarez, Elvis
Maldonado, Salvador Villarroel, Juan A. Bally and Claudio, who are all
transvestites, were arbitrarily arrested and subjected to beatings and ill
treatment by officers from Police Station # 3. On February 7th, 2003, three
police vans from Los Andes Police Station # 3 arrived at the corner of Avenida
Argentina and Santa Rosa and began beating the persons in question without any
warning, then arrested them, without charging them with any crime. They were
then taken to the Police Station, where they were forced to undress and were
beaten again. According to the complaints that they registered later, police
officers subsequently poured cold water on them and forced them to spend the
night in their cells, without allowing them to dry or cover themselves. They
were released the following morning, having been charged with "offending modesty
and good customs". The whole procedure was reportedly approved and supervised
by Rodrigo Jonquera, the officer in-charge of the Station.
On February 8th, 2003, four other transvestites, whose identities are currently
unavailable, were reportedly beaten and then arrested at the same spot. They
were also released the following morning and charged with "offences to modesty
and good customs".
Furthermore, the city of Los Andes has reportedly been the stage of at least two
murders of trans people that have never been investigated by local police. In
August 2002, a transvestite known as
"La Wanda" (Hugo Andres Godoy) was beaten to death by unknown persons. In May
2002, "La Pilar" (Wladimir Ibanez Carrasco), a 42-year-old transvestite, was
found dead in a nearby river.
TravesChile, the organization of which the six arrested transvestites are
members, has chapters in Santiago and in other Chilean cities. Due to their work
against police harassment, they have been the targets of intimidation more than
once. On July 2002, the Santiago chapter of the organization denounced death
threats they had received from a Police sergeant and a corporal from Santiago
Police Station # 4. Activists managed to record the corporal's plate number
(947521 R), but, in spite of the fact that they took their claims to the media
and to authorities like the Carabineros (the name of police forces in Chile)
Order and Security Department Chief, General Nelson Godoy, the case received no
further investigation or resolution. Since June 28, 2002 (Pride Day) TravesChile
faced an intense campaign of hate mail and death threats through their
electronic mail address, but the police have reportedly refused to investigate.
Ms. Silvia Parada, the President of TravesChile Santiago, has filed a petition
for investigation with the 9th Santiago Criminal Court, but no investigation has
yet been launched.
The International Secretariat of OMCT is gravely concerned by these reports of
arbitrary arrests, ill-treatment and beatings of the afore-mentioned
transvestite persons in Los Andes, as well as the
harassment and threats to which these people are continuing to face throughout
Chile. OMCT is also gravely concerned by the lack of investigations into such
acts of intimidation and attacks, including the two reported cases of murders of
transvestites. OMCT therefore calls upon the authorities to guarantee the
physical and psychological integrity of all transvestite persons in Chile,
notably in Los Andes in this case, and to ensure that immediate, impartial and
effective investigations are launched concerning these grave allegations, in
order to bring the perpetrators of these acts to justice.
Action requested
Please write to the authorities in Chile urging them to:
i. take all necessary measures to guarantee the physical and psychological
integrity of transvestite persons in Los Andes and throughout Chile;
ii. put an immediate end to the persecution and harassment of transvestites;
iii. guarantee an immediate investigation into the circumstances of these events,
identify those responsible, bring them before a civil competent and impartial
tribunal and apply the penal, civil and/or administrative sanctions provided by
law;
iv. guarantee adequate reparation to all injured people;
v. guarantee the respect of human rights and the fundamental freedoms throughout
the country in accordance with international human rights standards.
